Murderer tried to rob takeaway

A PAROLED murderer convicted of robbing a Chinese takeaway owner by threatening him with a chopping knife is back behind bars.

Victim Michael Fu fled in terror from his China Palace takeaway in Stafford after James Dailey picked up a meat cleaver and pointed it at him.

Dailey was out of prison on licence, having served 19 years for kicking replica breitling and asphyxiating a man to death in Silverdale Road, Newcastle, in 1987.

He was released in August 2007.

Dailey and his two coaccused, siblings Christopher and Kerry Smith, were yesterday convicted at Stafford Crown Court of robbing Mr Fu on February 18 last year.

Dailey, aged 46, of Wedgwood Avenue, Stone, 24-year-old Christopher Smith, of Pennycrofts Court, Stafford, and his sister, aged 23, of Hawksmoor Road, Stafford, had denied the charge.

Mr Fu told the jury he was so scared he ran out of his takeaway in Gaol Road when the two men and woman demanded money.

He said replica rolex Dailey picked up a meat cleaver, pointing it at him, while Christopher Smith threatened to beat him up.

The shop was not open when the robbery took place, but Mr Fu was preparing for the evening's business when he heard a knock at the door.

It was the defendants, two of whom he recognised, including Kerry Smith to whom he had loaned small sums of money in the past.

She was allowed in and the others came in with her.

Immediately, they started demanding money from Mr Fu, but he was unwilling to hand any over.

Christopher Smith went in to the kitchen on the pretext of using the toilet and picked up a jar of loose change. He was told to leave it alone.

Dailey entered the kitchen and picked up a steel chopper, which he held towards Mr Fu in a threatening way and demanded he handed over money. Mr Fu said Dailey picked up the chopper and raised it.

"He was pointing at me. He was looking at me, he was saying 'give her the money'. "I felt scared and I just ran out of the shop."

Kerry and Christopher followed him out and they were still asking for money.

Christopher threatened to beat him up, so he gave Kerry Pounds 5. Harry Owen, defending, said Dailey had been recalled to prison under the terms of his life sentence.

Recorder Nicholas Cartwright, remanded the Smiths in custody and will sentence them, together with Dailey, later today.
